Royal decree amending the royal decree of April 4, 2019 on the making available on the market and use of biocides (14 JULY 2024).
A new royal decree introduces measures to improve the regulation of biocide sales and promotion while enhancing the information provided to consumers.
Starting January 1, 2025: Revised Sale and Use Conditions for Biocides
The updated decree requires that biocides sold in Belgium must have valid authorization, and their usage must strictly follow the conditions of the authorization. For example, expired products can no longer be sold or used.
Additional obligations have been set for manufacturers:
- Notify distributors and users of end dates for product sale and use;
- Provide free guidance on proper disposal methods for products and packaging.
Starting January 1, 2027: New Advertising and Labeling Standards for Biocides
Advertising Requirements
- All advertisements must include the product name and authorization number.
- Advertisements must feature the message: “Use biocides safely. Before use, read the label and product information.”
- Public advertising is prohibited for biocides with a hazard score of 4 or higher, reflecting their toxicity and impact on health and the environment.
Labelling Standards
- The product name and authorization number must be clearly displayed on the front of the label for easy identification.
- Labels must list any substances of concern (as defined in Article 3).
- Hazardous biocides must feature a full label in Dutch, French, and German, with some information in German accessible via QR code or similar.
- Non-hazardous biocides should also be labelled in Dutch, French, and German, with German content optionally available through a QR code or similar means.
